H.R. 1189 PASSES HOUSE; MAKES TECHNICAL CORRECTIONS
On April 13, H.R. 1189, which makes technical corrections in title 17, U.S.C., and other
laws, passed the House. H.R. 1189 makes technical amendments to the Digital Millennium
Copyright Act (DMCA) and the Fairness in Music Licensing Act. Among other things, it
redesignates as 17 U.S.C. sec. 513 the section that was designated as sec. 512 in the
Fairness in Music Licensing Act. The Fairness in Music Licensing Act and the Digital
Millennium Copyright Act had each added a new section 512 to Title 17, and it was
necessary to renumber one of those two sections. Section 512 in the DMCA governs online
service provider liability. In addition, H.R. 1189 resolves a discrepancy between 17
U.S.C. sec. 1310 and 1302(5). The amendment makes it clear that registration of a design
must be made within 2 years of the date on which the design is first made public.
