Copyright Office Proposes Regulations for Notice and Recordkeeping for Use of Sound Recordings under Statutory Licenses

The Copyright Office is proposing regulations for the delivery and format of records of use of sound recordings by nonsubscription transmission services (including webcasters), preexisting satellite digital audio radio services, new subscription services, and business establishment services availing themselves of the statutory licenses set forth in 17 U.S.C. 112 and 114. The Office is seeking to establish the format in which each record of use must be kept, along with directions for delivery of the data to the Receiving Agent, which is SoundExchange, Inc. The deadline for the Copyright Office to receive comments on the proposed rules is May 27. The new Copyright Royalty Judges will assume responsibility for this ongoing rulemaking proceeding on May 31. (Read further information.)

Amendments to Rules Governing Reports of Use of Sound Recordings under the Statutory License for Preexisting Subscription Services Adopted

The Copyright Office is adopting amendments to the rules governing reports of use of sound recordings under the statutory license for preexisting subscription services. The new rules are effective June 8. (Read further information.)
