Beginning November 18, the initial round of comments in the Copyright Office triennial rulemaking proceeding on exemptions from the prohibition on circumvention of technological measures that control access to copyrighted works may be filed electronically through the Copyright Office website. Comments will be limited to those proposing specific classes of works to be exempted.

These comments will be limited to those proposing specific classes of works to be exempted.

February 19, 2003

Deadline for the second round of comments in the Copyright Office triennial rulemaking proceeding on exemptions from the prohibition on circumvention of technological measures that control access to copyrighted works. Those who oppose or support any exemptions proposed in the initial comments will have the opportunity to respond to the proposals made in the initial comments and to provide factual information and legal argument addressing whether a proposed exemption should be adopted.

Librarian of Congress Denies Motion for Stay of Webcasting Rates

The Librarian of Congress, on the recommendation of the Register of Copyrights, has denied a motion by Live365.com Inc. for a stay of the Final Rule and Order published July 8, 2002, that established rates and terms for the statutory license for eligible nonsubscription services to perform sound recordings publicly by means of digital audio transmissions ("webcasting") and the statutory license to make ephemeral recordings of sound recordings to facilitate such public performances.
